Please be advised that as of 1 January 2011, new Australian Consumer Law will become effective. This includes a strengthening of consumer protection laws and enforcement powers of the consumer regulators (such as the ACCC) and a new prohibition impacting upon extended warranties, which will apply to all new & used car dealers and Boat and motorbike dealers. As part of the Australian Consumer Law package of reforms, a new consumer guarantee regime will be introduced. The regime requires suppliers, such as new & used car dealers and boat dealers and motorbike dealers, to provide certain statutory guarantees to consumers in relation to the goods and services they supply. For example, dealers who sell motor vehicles will provide a statutory guarantee that those motor vehicles are of acceptable quality. Such guarantees may go beyond those provided under State statutory warranty requirements.
In some respects the new regime reflects existing implied terms under the Trade Practices Act and fair trading legislation, but specific differences include:
- Remedies will be set out in the legislation (e.g. repair or refund) so that consumers are aware of what they are entitled to when things go wrong; and
- Consumer regulators such as ACCC and ASIC will have the power to take representative action on behalf of consumers for breach of the guarantee
In addition, the new laws include a prohibition on making false or misleading representations concerning the requirement to pay for a contractual right that is wholly or partly equivalent to any condition, warranty guarantee right or remedy that a person has under a law of the Commonwealth, a State or Territory. Swann believes this new prohibition could be used to target extended warranties sold by car dealers. Accordingly Swann is reviewing, and where appropriate modifying, our extended warranty product wording, dealer training and procedures, to help ensure our authorised representatives will be fully compliant with the new requirements. New extended warranty policy wording and education of all applicable Swann authorised representative staff, will be completed before 1 January 2011.
For those motor vehicle dealers who either issue their own extended warranty products and /or distribute extended warranty products issued by other insurers, we strongly recommend that a complete and thorough review of your sales and marketing processes and procedures be undertaken before 1 January 2011 so as to avoid breach of the prohibition and the potentially serious consequences flowing from such a breach. A breach of the new prohibition can result in civil pecuniary penalties, infringement notices, actions for redress by consumer regulators and possible criminal sanctions.
